Toney fails drug test; win over Ruiz ruled no decision

Less than two weeks after claiming the WBA heavyweight title with a win over John Ruiz, James Toney will likely have to give the belt back after a violation of the illegal substance rule. The New York State Athletic Commission overturned the victory -- ruling it a no decision -- and suspended Toney for 90 days with a fine of $10,000. The NYSAC did not specify which drug resulted in the positive test, but Toney's camp has identified it as the steroid nandrolone. Toney released a statement and denied ever using an illegal substance. "Being accused of taking performance-enhancing substances is an insult to me," said Toney. "I don't do drugs period." His promoter, Dan Goossen, added that prescription drugs from a doctor for treatment of a torn biceps and triceps might have been the cause of the positive test. "His doctor has stated that the combination of medications used to control the inflammation and tissue growth caused the positive test result," Goossen said in the statement. "This is further support, since the body, in combination with the medications, naturally create the form of substance (nandrolone) reflected in the test results." In addition, Ruiz, who un-announced his retirement on Monday as word of the failed test spread, may be given the title back by default. According to WBA Rule 18:23: "If the challenger wins the championship fight and his antidrug test is positive and the losing champion has a negative result, then the champion shall retain his title in spite of the loss and the challenger shall be disqualified and shall not box for the title from the World Boxing Association during the next two (2) years and only after presentation of medical evidence that he has been rehabilitated." "We are waiting for the WBA to immediately implement its rule," Ruiz's attorney Anthony Cardinale said. "It's as clear as it can be. We're glad the truth has come out and Johnny hasn't lost his championship." Toney had won the April 30th bout at Madison Square Garden decisively on all three scorecards, as he claimed the title that Ruiz won with a victory over Hasim Rahman after Roy Jones Jr. had vacated his belt
